Abstract

This paper identifies, analyses and assesses contemporary as well as emerging navigational issues under the United Nations Convention on the Law of the Sea 1982 (LOSC). The paper is divided into thee parts, including: an overview of the place of navigation in the LOSC, how the LOSC impacts Australia, and identifying emerging trends and issues which impact the framework of rules. This paper also covers issues such as: the effect of excessive maritime claims, the pressures applied by technological developments and innovation, the impact of ‘at sea’ operations by insurgents, terrorists and organised crime, and the effects of ‘gap-filling’ activities by international organisations.
